Asuransi Syariah Perlu Sosialisasi Ulama



REPUBLIKA.CO.ID, BOGOR - Para ulama perlu berperan dalam menyosialisasikan industri asuransi syariah ke masyarakat. Pasalnya, asuransi syariah memiliki captive market di umat sehingga dalam pengembangannya perlu partisipasi ulama.

Dewan Pengawas Syariah (DPS) PT Asuransi Takaful Keluarga (ATK) Muhidin Junaedi mengatakan, perusahaan asuransi syariah harus mengubah pendekatannya dengan masyarakat. “Karena asuransi syariah punya captive market di umat, jadi ya datangilah lembaga pendidikan Islam, pesantren, organisasi masyarakat Islam, dan tawarkan produk di sana,” ucapnya kepada Republika di Bogor, Selasa (18/6).

Selama ini, ulama hanya membaca dan mengkaji kitab kuning, tetapi belum menjadi bagian sosialisasi ekonomi syariah di kehidupan nyata. “Makanya kami berusaha rangkul mereka. Saya pikir cara itu bisa mengena,” kata pria yang juga menjabat sebagai Ketua Majelis Ulama Indonesia (MUI) Pusat Bidang Hubungan dan Kerja Sama Internasional ini.

Menurutnya, paradigma ulama masih cenderung konvensional dalam berpikir. Pada dasarnya, ulama telah memahami arti penting asuransi syariah. Hanya saja, kata Muhidin, mereka kurang memahami permasalahan teknis dan teknologi dari industri tersebut.

MUI sering mengajak para ulama berdiskusi mengenai keunggulan produk asuransi syariah maupun bank syariah. Para ulama pun menyambut baik ajakan MUI untuk menyosialisasikan ekonomi syariah.

Muhidin mengatakan, ada beberapa faktor yang menyebabkan masyarakat kurang paham mengenai asuransi syariah. “Titik lemah asuransi syariah adalah iklan dan sosialisasinya sangat minim,” ujarnya.

Selain itu, masyarakat belum terbiasa menjadi pemegang premi karena masih banyak yang hidup di bawah garis kemiskinan sehingga tidak terpikir menggunakan jasa asuransi. Ada juga tantangan eksternal dari asuransi konvensional yang mempromosikan produknya besar-besaran dan berani mengeluarkan bermacam produk menarik bagi konsumen.

Sebagai DPS dari Takafuf, Muhidin pun memberikan komentarnya mengenai perusahaan tersebut. “Dalam konteks lokal, harus saya akui Takaful belum down to earth,” ucapnya. Takaful belum menjadi bagian denyut nadi masyarakat meski telah menjadi pelopor industri asuransi syariah Indonesia.

Secara historis, harusnya Takaful berada jauh di depan asuransi syariah lainnya. Muhidin berujar, apa yang dicapai Takaful sejak berdirinya hingga sekarang belum maksimal dan masih mempunyai ruang perbaikan. Masyarakat hanya baru mengenal nama saja, tetapi belum mengenal betul bentuk produk, apalagi di tingkat grass root (akar rumput). Oleh karena itu, ini kesempatan besar bagi Takaful untuk mendekatkan diri ke kalangan bawah. “Takaful harus turun ke bawah, saya optimistis kalau pendekatan Takaful diubah menjadi cara yang lebih membumi atau blusukan maka bisa mengambil pangsa pasar besar,” katanya.

Ketua I Ikatan Alumni Ekonomi Islam (IAEI) Agustianto mengatakan, ulama menduduki posisi penting dalam masyarakat Islam. Peran ulama bukan hanya pada aspek ibadah dan memberikan fatwa saja, tetapi juga mencakup berbagai bidang politik, ekonomi, sosial, budaya, pendidikan, dan sebagainya sesuai dengan kekomprehensifan ajaran Islam itu sendiri. Terumuskannya sistem ekonomi Islam secara konseptual, termasuk sistem perbankan syariah, dan lembaga keuangan syariah lainnya adalah hasil ijtihad dan kerja keras intelektual para ulama.

Agustianto menyebut ada berbagai macam peran ulama dalam memasyarakatkan, menerapkan, dan membumikan ekonomi syariah. Ulama berperan menjelaskan kepada masyarakat bahwa ajaran muamalah maliyah harus diamalkan dan dihidupkan kembali sesuai dengan perintah Alquran dan sunah. “Selama ini, sebagian umat Islam telah melakukan aktivitas ekonomi maupun mengkaji ilmu ekonomi, tetapi sayang sekali, praktiknya banyak yang bertentangan dengan syariat Islam, seperti riba, maysir, gharar, dan bisnis batil,” ujar Agustianto.

Aktualisasi muamalah dapat diwujudkan, di antaranya, dalam bentuk asuransi syariah, perbankan syariah, leasing syariah, pasar modal syariah, koperasi syariah, dan baitulmal wa tamwil, pasar modal syariah (sukuk, saham, dan reksadana syariah), pegadaian syariah, dan multi level marketing (MLM) syariah.

Ulama, kata Agustianto, juga berperan menjelaskan keterpurukan ekonomi umat Islam selama ini di antaranya disebabkan umat Islam mengabaikan fiqh muamalah. Di sekolah tertentu, pesantren, misalnya, muamalah memang diajarkan namun sifatnya normatif dan dogmatis, belum dikembangkan sesuai dengan aplikasi perbankan dan keuangan kontemporer.

Ulama berperan mengajak umat untuk memasuki Islam secara kaffah (menyeluruh), tidak sepotong-potong. “Selama ini masih banyak kaum Muslimin yang bergumul secara langsung dengan sistem bunga yang diharamkan Alquran dalam bank konvensional,” ucapnya. Menggunakan produk keuangan syariah merupakan upaya menuju Islam kafah sehingga tidak lagi menerapkan sistem kapitalis dalam kegiatan ekonomi.

Chief Shariah sekaligus Corporate Communication Allianz Indonesia Kiswati Soeryoko mengatakan, bisnis asuransi syariah dapat diterima baik oleh berbagai lapisan dan golongan masyarakat di Indonesia. Namun demikian, kata dia, potensi masa depan industri asuransi masih sangat besar sehingga proses edukasi dan sosialisasi masih harus ditingkatkan.

Untuk memperkuat komitmen perusahaan dalam mengembangkan bisnis asuransi syariah bagi masyarakat, Allianz akan memperkuat distribusi pemasaran produk melalui penambahan mitra-mitra bisnis perbankan dan juga terus menambah jumlah agen tesertifikasi syariah. Selain itu, Allianz Life Syariah juga akan memperkuat distribusi melalui jalur telemarketing. “Kami yakin bisnis asuransi jiwa syariah akan berkembang dengan baik di Indonesia karena model bisnisnya sangat sesuai dengan pola kehidupan masyarakat Indonesia yang berlandaskan asas berbagi dan tolong-menolong,” kata Kiswati. n qommarria rostanti ed: irwan kelana

Market Leader Asuransi Umum 2013

Di tengah ketatnya persaingan bisnis dan tekanan regulasi di tahun 2012, kinerja asuransi umum masih mampu mencatat pertumbuhan. Data hasil kajian LRMA mencatat, posisi aset 82 asuransi umum selama 2012 mencapai Rp. 81,90 triliun. Terjadi kenaikan 15,97 persen dibanding pencapaian 2011 yang nilainya Rp. 70,62 triliun. Premi penutupan langsung sebesar Rp. 22,113 triliun, meningkat 14,13 persen dibandingkan tahun sebelumnya. Sedangkan perolehan laba komprehensive melonjak signifikan 47,79 persen menjadi Rp. 5,63 triliun, padahal pada 2011 masih sebesar Rp. 3,81 triliun.(Disarikan dari Media Asuransi, Juni 2013)

Market Leader Asuransi Jiwa 2013


Meningkatnya jumlah masyarakat kelas menengah, mendorong pasar asuransi jiwa tumbuh lebih cepat. Kesadaran dan kebutuhan berasuransi masyarakat meningkat. Lembaga Riset Media Asuransi (LRMA) mencatat kenaikan pendapatan premi sebesar 11,11 persen di tahun 2012, yaitu dari Rp. 93,89 triliun pada 2011 menjadi Rp. 104,32 triliun. Sedangkan dari sisi asset dan ekuitas, pertumbuhannya masing-masing 17,65% dan 23,25%.

Kesehatan Asuransi Bumi Asih Negatif

JAKARTA, KOMPAS.com - Otoritas Jasa Keuangan (OJK) memutuskan PT Asuransi Bumi Asih Jaya (BAJ Life) masuk ke dalam kategori Pembekuan Kegiatan Usaha (PKU). Pihak regulator ini menegaskan, BAJ Life harus memenuhi kewajibannya terhadap nasabah.

"Mereka harus selesaikan dulu kewajibannya," ucap Anggota Dewan Komisioner bidang Industri Keuangan Non Bank OJK, Firdaus Djaelani, Selasa, (18/6/2013).

Ia mengatakan bahwa Bumi Asih Jaya sudah ingin menyerahkan izin usahanya kepada OJK. Namun, OJK menolak dan meminta perusahaan tersebut bertanggung jawab terlebih dahulu terhadap nasabahnya.
Pasalnya, bila mereka memberikan izin usaha tanpa memenuhi tanggung jawab, BAJ Life akan terkena sanksi insolven dan administratif. Selain itu, dewan direksi juga akan kesulitan untuk bekerja di tempat lain.
Firdaus mengatakan, dalam kondisi PKU ini, perusahaan tak bisa menerbitkan polis baru. Mereka hanya bisa mengurus bisnis lama dan boleh menerima premi lanjutan. Perusahaan juga wajib membayar klaim bila ada yang jatuh tempo.

Ia beralasan, perusahaan dalam kategori PKU ini tak bisa menjual produk baru karena OJK ingin mereka berkonsentrasi mengatasi permasalahannya. Firdaus menilai, pemberian izin kepada perusahaan yang dalam kondisi tak sehat justru akan membuat lubang kerusakan semakin besar.

Untuk itu, OJK memberi tenggat waktu 1-2 bulan bagi BAJ Life untuk menyelesaikan tanggung jawabnya. Nanti jika tanggung jawab BAJ Life terhadap nasabahnya sudah usai, OJK baru bisa mencabut izin usaha perusahaan yang sudah beroperasi sejak tahun 1967 ini.

OJK melakukan PKU terhadap BAJ karena Risk Based Capital (RBC) yang sudah berada di titik negatif. Padahal berdasarkan ketentuan, RBC perusahaan asuransi normalnya berada di posisi minimum 120%. (Annisa Aninditya Wibawa/Kontan)

OJK minta bantuan IFC kembangkan asuransi mikro

JAKARTA. Demi memudahkan akses asuransi terhadap seluruh lapisan masyarakat, Otoritas Jasa Keuangan (OJK) menggandeng International Finance Corporation (IFC).
"Ini karena mereka pengalaman di negara lain mengembangkan asuransi mikro," jelas Anggota Dewan Komisioner bidang Industri Keuangan Non Bank OJK, Firdaus Djaelani, Senin, (17/6).

IFC sudah membantu mengembangkan asuransi mikro di India, Pakistan, Filipina, Amerika Latin, dan negara-negara lainnya. Kemudian dengan Indonesia yang memiliki wilayah yang luas dan jumlah penduduk 240 juta orang ini, tentunya akan sangat menjanjikan untuk pengembangan asuransi mikro.

OJK pun telah memiliki program untuk mengembangkan asuransi mikro bagi masyarakat kelas menengah bawah. Nantinya, asuransi ini haruslah merupakan produk yang sederhana, pengurusan klaim yang mudah, uang pertanggungan yang standar, premi murah, dan distribusi yang terjangkau.

Firdaus menyadari, hambatan utama dari program asuransi mikro yaitu bagaimana menyampaikannya kepada masyarakat kelas menengah bawah. Jadi, penyaluran produk ini tidak akan menggunakan agen atau bank, melainkan kerja sama dengan lembaga lain yang mudah dijangkau. Seperti melalui Pegadaian dan Lembaga Keuangan Mikro (LKM).

Untuk mendukung pengembangan asuransi mikro ini, OJK akan mengadakan konferensi internasional pada bulan November nanti. Rencananya, akan ada 300 orang dari berbagai belahan dunia yang didatangkan ke Indonesia. "Ini kerja sama kita dengan Bank Dunia," sebut Firdaus.

OJK Cabut Izin Asuransi Jiwa Nusantara

REPUBLIKA.CO.ID, JAKARTA--Otoritas Jasa Keuangan mencabut izin izin usaha PT Asuransi Jiwa Nusantara sebagai Perusahaan Asuransi Jiwa per 12 Juni 2012.

Pencabutan izin tersebut. berdasarkan Keputusan Dewan Komisioner Nomor KEP-42/D.05/2013 tanggal 12 Juni 2013. Pencabutan izin usaha tersebut mulai berlaku sejak tanggal ditetapkannya Keputusan Dewan Komisioner atas perusahaan tersebut.

Dalam keterangan persnya, Selasa (18/6), PT Asuransi Jiwa Nusantara dilarang melakukan kegiatan usaha di bidang asuransi jiwa. Perusahaan diwajibkan untuk menurunkan papan nama, baik di kantor pusat maupun di kantor lainnya selain kantor pusat.

Regulator jasa keuangan ini mengharuskan perusahaan menyelesaikan seluruh utang dan kewajiban. OJK tidak memberikan keterangan mengenai alasan penutupan perusahaan tersebut.

OJK Cabut Izin Usaha Asuransi Jiwa Nusantara

TEMPO.CO, Jakarta - Otoritas Jasa Keuangan telah mencabut izin usaha PT Asuransi Jiwa Nusantara. Pencabutan ijin tersebut dilakukan per tanggal 12 Juni 2013 berdasarkan Keputusan Dewan Komisioner OJK nomor: KEP-42/D.05/2013.

Deputi Komisioner Pengawas IKNB I, Ngalim Sawega mengatakan, PT Asuransi Jiwa Nusantara sudah tidak mampu lagi memenuhi ketentuan terkait dengan kesehatan keuangan seperti risk based capital, rasio pertimbangan investasi terhadap cadangan teknis dan utang klaim, serta pengembalian pinjaman subordinasi. Perusahaan tersebut juga sudah diberikan kesempatan memenuhi ketentuan dan dikenakan sanksi pembatasan kegiatan usaha hingga 10 Juni 2013.

"Tapi sampai batas waktu tersebut tidak dapat mengatasinya maka sesuai ketentuan perundang-uundangan yang berlaku haruus ditindaklanjuti dengan pencabutan ijin usaha,"ujar Ngalim dalam keterangan pers tertulisnya, Kamis, 13 Juni 2013.

Ngalim melanjutkan, meski telah dicabut izin usaha, perseroan tetap harus menyelesaikan seluruh kewajiban kepada pemegang polis. Untuk itu, perwakilan pemegang polis akan dibentuk guna mengawasi proses penjualan aset, penagihan aset kepada pihak ketiga, dan penyelesaian kewajiban kepada pemegang polis.

OJK sebagai pengawas juga akan terus memantau proses penyelesaian kewajiban serta memediasi pemegang polis dengan AJN."Pembubaran dilakukan setelah penyelesaian aset dan kewajiban PT. AJN,"kata Ngalim.

Bank Bukopin Kembangkan Bisnis Asuransi Jiwa

(Vibiznews-Banking) Glen Glenardi, Direktur Utama PT Bank Bukopin Tbk mengungkapkan, pihaknya akan mengembangkan bisnis asuransi jiwa yang diharapkan launching pada kuartal 3 tahun 2013.
Menurutnya, rencana tersebut masih dalam tahapan akhir diskusi mengenai share posisi mayoritas dan pemetaan pada kerjasama ini.
"Belakangan sharing dengan salah satu perusahaan asuransi jiwa dan sudah due dilligence," katanya usai Rapat Umum Pemegang Saham Tahunan (RUPST) di Kantornya, Jakarta, Kamis (13/06/2013).
Glen menjelaskan, pembicaraan tersebut masih terus dirundingkan dan belum dapat ditentukan berhubung dua-duanya ingin jadi pemegang mayoritas.
Meskipun demikian lanjutnya, Glen belum bersedia menyebutkan nama perusahaan asuransi yang akan diajak bermitra tersebut.
"Perusahaan tersebut masuk 8 besar asuransi jiwa, dengan pemegang sahamnya dominan lokal tapi ada asingnya juga. Tapi belum diputuskan, jadi nanti saja kalau sudah fix," tegasnya.

Untuk nominal rupiah yang disiapkan, Glen juga enggan untuk menjawabnya. "Belum bisa ditentukan besarannya," tuturnya.

Adapun dengan merambah bisnis asuransi tersebut sebagai salah satu langkah ekspansi yang dilakukan oleh Bank Bukopin.
"Sebenarnya kami sudah tertarik sejak tahun lalu, tapi tahun ini baru ada yang mau di ajak kerja sama," tambahnya.
Sebagai informasi, Bank Bukopin akan right issue sekitar 20-30 persen dengan target dana sebesar Rp 2-3 triliun dengan tujuan untuk menopang pertumbuhan bisnisnya serta menambah permodalan perbankan.

MA tolak pailitkan Asuransi Jiwa Buana Putra

JAKARTA. Nasabah PT Asuransi Jiwa Buana Putra agaknya haru gigit jari. Sebab, gugatan pailit mereka terhadap PT Asuransi Jiwa Buana Putra ditolak oleh Mahkamah Agung (MA).

Kuasa hukum PT Asuransi Jiwa Buana Putra, Diana Toha bilang, gugatan nasabah tersebut tidak sesuai dengan aturan. "Pada dasarnya putusan pengadilan dan MA sudah sesuai dengan undang-undang," kata Diana, Kamis (13/6).

Sebelumnya, majelis hakim pengadilan Niaga Jakarta Pusat juga telah menolak permohonan pailit dari nasabah. Hal ini tersebut karena dalam pasal 2 ayat 5 UU No.37/2004 tentang Kepailitan dan PKPU disebutkan, permohonan kepailitan terhadap perusahaan asuransi hanya bisa diajukan Menteri Keuangan.
Sementara dalam kasus ini, yang mengajukan pailit bukanlah Menteri Keuangan, melainkan nasabah perorangan.

Nasabah gigit jari
Adanya keputusan pengadilan itu membuat pusing pemohon pailit, yakni Tuti Supriyati, yang juga pemegang polis polis asuransi Dwiguna Bertahap Khusus dari PT Asuransi Jiwa Buana Putra. Perlu diketahui, Tuti menjadi nasabah sejak 28 Juli 1993 lewat polis nomor 186894 dengan masa pertanggungan 15 tahun yang mulai efektif berlaku sejak 1 Juli 1993.

Tuti juga sudah memenuhi kewajibannya melakukan pembayaran premi setiap tahunnya ke asuransi Jiwa Buana Putra. Dengan rincian, periode Juli 1993 sampai Juni 1994 sebesar Rp217.625, periode Juli 1994 sampai Juni 1995 sebesar Rp235.800, dan periode Juli 1995 sampai Juni 1996 sebesar Rp256.600.

Mengacu pada Polis No.186894 diatur bahwa dalam masa pertanggungan selama Tuti masih hidup, maka Tuti memiliki hak untuk menerima pembayaran pertanggungan asuransi dari asuransi Jiwa Buana Putra setiap bulan Juli pada tahun 1996, 1999, 2002, 2005, dan 2008 sebesar Rp500.000.

Sejauh ini, asuransi Jiwa Buana Putra hanya memenuhi kewajiban pembayaran pertanggungan pada tahun 1996 saja. Selanjutnya untuk 1999 sampai 2008 sama sekali kewajibannya tidak dilakukan tanpa alasan yang jelas. Jika dijumlah total kewajiban yang atau utang asuransi Jiwa Buana Putra mencapai Rp22,4 juta.
Karena itu, Tuti Supriyati mengajukan permohonan pailit hingga kasasi. Selain Tuti, ada tiga orang kreditur lain yakni Yunus Yuliawan, Joeliarman Bakir, Sumedi yang ketiganya warga Depok dan Suswanto warga Klender Jakarta Timur.

Sementara itu, kuasa hukum nasabah Elvi Noor belum dapat berkomentar karena belum terima salinan putusan. "Saya belum terima salinan putusannya, jadi belum ada komentar," katanya.

Investasi Emas Menarik Minat Asuransi Syariah

JAKARTA. Pelaku asuransi syariah akhirnya tak mampu menahan godaaan menempatkan dana mereka di instrumen investasi emas. Data Otoritas Jasa Keuangan (OJK) menunjukkan, pada triwulan I-2013, pelaku syariah menempatkan dana sebanyak Rp 4,5 miliar di keranjang emas.

Memang penempatan di keranjang ini masih terbilang kecil. Maklum, total dana investasi asuransi syariah pada akhir Maret lalu mencapai Rp12,78 triliun.
Artinya pos keranjang emas hanya 0,04%. Porsi emas masih minim, bisa jadi karena asuransi umum baru berani menjajal emas murni. Asuransi jiwa belum mencoba langkah ini.

Paling besar, dana asuransi ditempatkan di deposito yaitu sebesar Rp 5 triliun dengan porsi 39,17%, saham syariah Rp 3,18 triliun (24,86%), dan reksadana syariah Rp 2,6 triliun (20,41%). Sisanya di sukuk atau obligasi syariah, surat berharga syariah negara (SBSN), penyertaan langsung dan investasi lain.

M. Nasyubun, Kepala Divisi Syariah Asuransi Bumida, mengatakan tergoda berinvestasi di emas karena imbal emas cukup bagus, serta harganya susah turun. "Cukup likuid juga," kata dia kepada KONTAN, Rabu (12/6). Sejak awal tahun, anak usaha Asuransi Jiwa Bersama (AJB) Bumiputera tersebut menginvestasikan dana sebanyak 2 kilogram (kg) emas murni.

Bahkan, mereka berencana menambah porsi jika dana memungkinkan. Untuk keamanan, porsi terbesar investasi Bumida masih tetap di keranjang deposito. Dari total dana investasi sekitar Rp 10 miliar, lebih dari 50% investasi ditempatkan di keranjang safe haven itu.

Masih mahal

Bimo Kustoro, Kepala Divisi Syariah Asuransi Adira Dinamika (Adira Insurance), mengakui emas murni bisa sebagai alternatif investasi. Apalagi cenderung lebih aman dari gejolak pasar. Selain itu, imbal hasilnya menjanjikan.

Kendalanya, meski dalam tren turun, pelaku asuransi menilai, saat ini harga emas masih mahal. Sehingga membutuhkan dana besar jika ingin menaruh keranjang investasi di logam mulia. "Saya tentu akan bicara dengan bagian investasi jika memungkinkan, apalagi sudah diperbolehkan," ungkap Bimo.

Harga emas kemarin sebesar Rp 513.000 per gram. Angka ini menurun 11,43% sejak 2 Januari, yang seharga Rp 579.200 per gram, berdasarkan harga jual emas Antam.

Sejatinya, langkah asuransi syariah menjajal investasi emas bisa dimaklumi. Ada beleid PMK 11 tahun 2011, tentang Kesehatan Keuangan Usaha Asuransi dan Reasuransi dengan prinsip syariah, yang mengizinkan instrumen emas menjadi ladang mencari imbal hasil. Dengan syarat, mengantongi izin regulator dan disimpan di kustodian yang menjalin kerjasama dengan bursa komoditas.

Batas paling banyak investasi di emas adalah 20% dari jumlah investasi. Srikandi Utama, Wakil Ketua Asosiasi Asuransi Syariah Indonesia (AASI) Bidang Statistik, menyarankan agar mencermati return emas. Dia juga merekomendasikan keranjang pasar uang dan pasar modal. "Emas umumnya bersifat long term dengan risiko yang konservatif," tegasnya .

MA Tolak Kasasi Nasabah Asuransi Jiwa Buana

Langkah nasabah Asuransi Jiwa Buana, Tuti Supriati untuk memperoleh piutangnya harus kembali terhenti. Soalnya, Mahkamah Agung kembali menolak permohonan Tuti untuk menjadikan PT Asuransi Jiwa Buana Putra (AJBP) dalam keadaan pailit.

Sebenarnya, Mahkamah Agung sudah menolak kasasi Tuti sejak 20 Mei 2013. Namun, nasabah hingga saat ini belum mendapatkan salinan putusan dari Mahkamah Agung.
“Kami belum bisa berkomentar karena hingga saat ini belum menerima salinan putusan,” ucap Kuasa Hukum Nasabah AJBP Elvi Noor ketika dihubungi melalui telepon selulernya, Kamis (13/6).

Untuk diketahui, Elvi Noor mengajukan kasasi pada 24 April 2013 silam. Alasan pengajuan kasasi lantaran Elvi tak puas dengan penolakan Pengadilan Niaga pada PN Jakpus untuk memailitkan AJBP. Menurut Elvi, majelis tidak mempertimbangkan dalil hukumnya, yaitu perihal kewenangan pengadilan untuk mempailitkan lembaga keuangan atau asuransi tanpa seizin Menteri Keuangan.

Kala itu, majelis hakim yang dipimpin Noer Ali menyatakan menolak permohonan pailit nasabah. Putusan ini berpegang pada Pasal 2 ayat (5) UU Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Pasal tersebut mengatur bahwa yang berhak mengajukan permohonan pailit atas suatu perusahaan asuransi adalah Menteri Keuangan.

Sebaliknya, jika Elvi Noor telah mengetahui Mahkamah Agung menolak kasasinya, Kuasa Hukum AJBP Diana Thoha sama sekali belum mengetahui penolakan tersebut. Diana justru baru mengetahui perihal tersebut dari wartawan.

Meskipun belum mengetahui MA telah memutus perkara tersebut, Diana mengatakan bahwa putusan Mahkamah Agung telah tepat. Putusan MA yang digawangi oleh Hakim Agung Syamsul Ma’arif, Takdir Rahmadi dan I Made Tara ini menurut Diana telah sesuai dengan apa yang diamanatkan UU Kepailitan dan PKPU.

“Pada dasarnya, putusan dari PN dan MA sudah sesuai dengan UU. Karena belum tau isi putusannya seperti apa, yang jelas MA menguatkan putusan PN,” ujar Diana ketika dihubungi wartawan, Kamis (13/6).
Untuk diketahui, Tuti Supriati adalah salah satu nasabah AJBP. Ia bergabung menjadi salah satu pemegang polis pada 28 Juli 1993. Tuti menjadi pemegang polis asuransi Dwiguna Bertahap Khusus dengan nomor 186894 dengan masa pertanggungan selama 15 tahun. Masa pertanggungan ini mulai berlaku efektif sejak 1 Juli 1993.

Sebagai pemegang polis, Tuti dalam masa pertanggungannya selama masih hidup berhak untuk menerima pembayaran pertanggungan asuransi setiap bulan Juli pada 1996, 1999, 2002, 2005, dan 2008 sebesar Rp500 ribu.

Agar Tuti mendapatkan haknya sebagai pemegang polis, Tuti pun menjalankan kewajibannya, yaitu membayar premi setiap tahunnya. Rinciannya adalah periode Juli 1994-Juni 1994 adalah sebesar Rp217.625. Untuk periode Juli 1994-Juni 1995, Tuti membayar Rp235.800 dan sebanyak Rp256.600 untuk periode Juli 1995-Juni 1996.

Pada mulanya, hak dan kewajiban berjalan lancar. Namun, pada 1999 sampai 2008, AJBP tidak lagi menjalankan kewajibannya tanpa alasan yang jelas. Setelah diperingatkan beberapa kali, Tuti memutuskan menempuh jalur hukum. Adapun total utang yang jatuh tempo dan dapat ditagih hingga saat ini adalah Rp22,4 juta.

Asuransi Nasional Diperkirakan Banyak Dicaplok Asing

JAKARTA, KOMPAS.com - Lembaga pemeringkat,PT Fitch Ratings Indonesia, memperkirakan perusahaan asing akan banyak yang masuk ke Indonesia untuk mengakuisisi perusahaan asuransi nasional. Selain pasar yang sangat potensial, industri asuransi dalam negeri yang berskala kecil saat ini juga dihadapkan pada aturan modal minimal yang disayaratkan pemerintah.

Cheryl Evangeline, analis asuransi Fitch Ratings menuturkan momen masuknya perusahaan asuransi Jepang, Dai-ichi Life, mengakuisisi 40 persen saham Panin Life akan diikuti oleh perusahaan lain dari luar negeri untuk melakukan hal yang sama.
"Kami memperkirakan asuransi lokal akan melakukan hal yang sama, yaitu bergabung dengan perusahaan lain untuk menjawab pasar yang sangat atraktif saat ini. Hal ini lantaran pasar di Indonesia belum sepenuhnya terbuka," tulis Cheryl dalam siaran pers yang dikutip Senin (10/6/2012).
Dia menjelaskan, saat ini rasio penetrasi asuransi di Indonesia baru 1,7 persen dari total produk domestik bruto, atau jauh tertinggal dari China dan India. Selain itu, pangsa pasar asuransi syariah (takaful) juga masih cukup luas. Di luar itu, naiknya kesadaran terhadap bencana alam akan mendorong permintaan masyarakat terhadap asuransi.
"Bagi investor dari luar negeri, satuhal yang menarik minat mereka menanamkan modalnya ke Indonesia adalah batas maksimal kepemilikan bisa hingga 80 persen. Hal ini berbeda dengan di India yang maksimal 26 persen dan Thailand 49 persen," tulisnya.
Sementara itu terkait dengan kewajiban modal minimal, pemerintah sebelumnya telah mensyaratkan perusahaan asuransi memiliki modal minimal sebesar Rp 70 miliar pada akhir 2012 dan Rp 100 miliar pada akhir 2014.
"Kami melihat kebijakan tersebut cukuppositif untuk meningkatkan kekuatan modal industri asuransi, karena menyediakan penyangga yang cukup terhadapklaim," lanjutnya.

Pan Pacific Garap Pasar Indonesia Timur

Jakarta - Setelah sukses melakukan ekspansi di wilayah Barat Indonesia, kali ini PT Pan Pacific Insurance melebarkan sayap di wilayah Timur Indonesia.

Langkah perusahaan asuransi umum itu dilakukan dengan membuka satu kantor cabang di Denpasar, Bali.
"Setelah sebelumnya kami membuka kantor cabang Padang, hari ini Selasa kami membuka kembali cabang di Bali," kata Presiden Direktur Pan Pacific Insurance, Marcel Colondam dalam keterangan tertulisnya, Selasa (11/6).

Marcel mengatakan, aksi korporasi ini bertujuan untuk menjangkau nasabah di wilayah tersebut yang trennya semakin meningkat. Khusus di wilayah Indonesia Timur, Pan sebelumnya telah memiliki kantor cabang di Makassar dan Balikpapan.
"Dengan adanya kantor Denpasar, konsumen yang belum terjangkau oleh kantor perwakilan kami akan terlayani dengan baik," kata dia.

Marcel menambahkan, pembukaan cabang di Denpasar menggenapkan kantor Pan Pacific menjadi 18 kantor dari sebelumnya 17 kantor. Hingga akhir tahun 2013, cabang Denpasar diharapkan dapat meraih premi sekitar Rp 2,5 miliar.
Adapun secara total Pan Pacific menargetkan premi sebesar Rp 428 miliar naik signifikan dibanding 2012 sebesar Rp 300 miliar.

Lini bisnis Pan Pacific sebagian besar dikontribusikan oleh produk asuransi kendaraan bermotor sebesar 65 persen, produk asuransi kesehatan sebesar 20 persen dan sisanya masing-masing sebesar 5 persen disumbangkan produk asuransi properti, marine cargo, dan lain-lain.

OWN SURROUNDING PROPERTY (VERSI ADIRA INSURANCE)

The Insurer will subject to the Limit of Liability stated in the Schedule indemnify the Insured against impact damage to Own Surrounding Property directly resulting from sudden and unforeseen damage as defined in the Specification of this Policy to the machinery described in the Schedule.
“Own Surrounding Property “ shall mean property belonging to the Insured or in his custody or control other than :
-    Any part of the machine causing the damage or any machine or apparatus directly driving or driven by such plant
-    Property being lifted conveyed handled heated cooled or processed

OUTSIDE PREMISES STORAGE CLAUSE

Where the Insured enters into a contract for storage of goods and/or merchandise and the terms of the storage contain a disclaimer clause, then the insurance provided by the Policy shall not be prejudiced by the Insured agreeing to such terms.

OUTPUT SUBSITUTED FOR TURNOVER CLASUE

It is agreed that in the event of a claim arising under this section, adjustment may be based on "turnover or output" or whatever other index of business activity affords the insured the most equitable result and except in the definition of turnover, the word "turnover" wherever used in this policy shall read as "turnover" or output. Output shall mean sale value of goods manufactured by, or sold by, the Insured in the course of the business at the premises, or internal transfer value as between departments of finished or partially processed stock manufactured by Insured at the premises.
Provided that:
(i)    Only one such meaning shall be operative in connection with any one occurrence involving damage as within defined.
(ii)    If the meaning set out in this clause be used, memo shall be held to be altered to read as follows.
Memo:    if during the indemnity period goods shall be manufactured and/or processed elsewhere then at the premises affected by the damage for the benefit of the business either by the Insured or by others on the Insured's behalf, the sale value of the goods so manufactured shall be brought into account in arriving at the output during the indemnity period.

OUTPUT REPLACEMENT CLAUSE

Any property insured which has a measurable output and which is capable of replacement with a new item or items which performs a similar function is valued for insurance purpose in respect thereof shall be on the same basis.
(i)    If property lost, destroyed or damaged is to be replaced by an item or items which has or have the same or lesser total output, then the insurable value thereof is the new installed cost of such replacement item or items as would give the same total output as the property lost or damaged.
(ii)    If property lost or damaged is to be replaced by an item or items which has or have a greater total output, then if property is not available with the same total output then no deduction shall be made from any claim for the improved output.

Provided that in the event of partial loss where property is to be repaired this policy shall pay the cost of restoration of the damaged property to a conditions substantially the same but not better or more extensive than its conditions when new.

OUTPUT OPTION ENDORSEMENT

Subject to the terms and provisions of this Endorsement and all the terms, provisions, conditions, limitations and exclusions of the Policy of which this Endorsement forms a part which are not specifically modified by this Endorsement, it is declared and agreed that at the option of the Insured, the term "Output" may be substituted for the term "Turnover" in which case "Output" shall mean :
The sale value of goods manufactured by the Insured in the course of the Business at the Insured locations.

Where this option is taken Items l(a) and l(b) of the Specification to Section 2 of this Policy will read as follows :
(a)    In respect of Reduction in Output: The sum produced by applying the Rate of Gross Profit to the amount by which Output during the Period of Indemnity shall fall short of the Standard Output.

(b)    In respect of Increase in Cost of Working: The additional expenditure necessarily and reasonably incurred for the sole purpose of avoiding or diminishing the reduction in Output which, but for that expenditure, would have taken place during the Indemnity Period, but not exceeding the sum produced by applying the Rate of Gross Profit to the amount of the reduction thereby avoided.

All less any sum saved during the Indemnity Period in respect of such of the Insured Gross Profit as may cease or be reduced in consequence of the Damage.

Definitions
Standard Output   The Output during that period in the twelve months before the date of the Damage which corresponds with the Indemnity Period.

Rate of Gross Profit   The percentage that the Insured Gross Profit bears to the Output.
In determining the indemnity payable, the amounts of Rate of Gross Profit and Standard Output, as defined, shall be based upon the estimated production programme of the Business, and costs and prices relating thereto and subject to such adjustments as may be necessary to provide for the trend of the Business and for variations in, or special circumstances affecting the Business, either before or after the Damage, or which would have affected the Business had the Damage not occurred, so that the figure thus adjusted shall represent as nearly as may be reasonably practicable the results which but for the Damage would have been obtained during the relative period after the Damage.

It is understood and agreed that in the event of loss under this Section of this Policy, the Insured shall notify the Insurers in writing within 30 days of resumption of normal business operations, of the option he elects, and the entire adjustment of that loss shall be carried out subject to the terms and conditions of the elected option as herein defined.

OUTBUILDING CLAUSE

The insurance by each item under building is understood to include walls, gates and fences, small outside buildings, extensions, annexes, exterior staircase, fuel installations, steel or iron framework and tanks in the said premises and the insurance by each item under contents extends to contents of each outbuilding, provided their values are included in the sum insured.

OTHER INTEREST CLAUSE

Lessors, financiers, mortgagees, trustees, of risks or of contractors, subcontractors and other as noted in the Insured’s records have an interest in this insurance, the nature and extent of such interest to be disclosed in the event of loss, destruction or damage.
Where this insurance covers the interest of more than one party, any act or neglect of any individual party will not prejudice the right of the remaining party/parties.

Notwithstanding the situation described in the schedule the cover afforded by this policy extends to include any materials, plant or items, being manufactured , whilst located anywhere in Jabotabek area and subject to a maximum value of ………………. OCCUPIER’S LIABILITY CLAUSE

Notwithstanding of anything contained in the policy, this insurance is extended to cover for loss or damage to the tenant’s and guest’s property occurring at the insured premises, controlled by the insured security to which this policy applies as described in the schedule.

NUCLEAR EXCLUSION CLAUSE - Ver 2

It is hereby noted and agreed that this policy does not cover Death or Disablement directly or indirectly caused by or resulting from :
a.    Ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion or nuclear fuel.
b.    The radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.
All other terms and conditions remain unchanged.

NEW BUILDING/PROPERTY CLAUSE

It is hereby declared and agreed that loss as insured by this Section of this Policy resulting from interruption of or interference with the Business in consequence of Damage to property at premises in respect of which the Insured have entered into a contract to have constructed, to purchase, to lease or to tenant shall be deemed to be loss resulting from damage to property used by the Insured at the insured locations.

It being understood and agreed that the provision herein shall not extend the scope of this Policy to provide any form of Advance Loss of Profit

Provided that, after the application of all the terms, conditions and provisions of this Policy the liability of the Insurers under this Section of this policy shall not exceed the Sum(s) Insured in respect of this Section of this Policy.

NEW BUSINESS CLAUSE

For the purpose of nay claim arising from damage occurring before the completion of the first year’s trading of the business at the premises, the terms “Gross Rental”, “Annual Gross Rental” and “ Standard Gross Rental” shall bear the following meanings and not as within stated.

Gross Rental :
The money paid of payable to the Insured by tenants in respect of rental of the premises.

Annual Gross Rental :
Proportional equivalent, for a period equal to the Indemnity Period, of the Gross Rental realized during the period between the Business and the date of the Incident.

Standard Gross Rental :
The proportional equivalent, for a period equal to the indemnity Period, of the Gross Rental realized during the period between the commencement of the Business and the date of the Incident.

To which such adjustment shall be made as may be necessary to provide for the trend of the Business and for the variations in the business either before or after the damage or which would have affected the  Business had the damage not occurred. So that the figures thus adjusted shall represent as nearly as may be reasonably practicable the results which but for the damage would have been obtained during the relative period after the damage.

MOLD & FUNGI ENDORSEMENT CLAUSE

A.    This Policy only insures physical loss or damage to property insured by mold, mildew, fungus or spores, when directly caused by damage to property insured during the policy period by one of the following Listed Perils:
Fire; Earthquake; Explosion; Lightning; Windstorm; Hail; Flood or Water Damage; Direct impact of vehicle; Aircraft or vessel; Riot or civil commotion; Vandalism or malicious mischief; or Accidental discharge of fire protection equipment.
This coverage is subject to all limitations of the Policy and, in addition, to each of the following specific limitations:
1.    The said property must be insured for physical loss or damage by that Listed Peril.
2.    The Insured must report to the Insurer the existence and cost of the physical loss or damage by mold, mildew, fungus or spores as soon as practicable, but no later than six (6) months after the Listed Peril first caused any physical loss or damage to such insured property during the policy period. This Policy does not insure any physical loss or damage by mold, mildew, fungus or spores first reported to the insurer after that six (6) month period.

B.    Except as set forth in the foregoing Section A, this Policy does not insure any loss, damage, claim, cost, expense, or other sum directly or indirectly arising out of or relating to mold, mildew, fungus or spores of any type, nature or description.

MORTGAGEE (CHARGEE) CLAUSE

As Mortgagee (Chargee) as interest may appear and this insurance, as to the interest of the Mortgagee (Chargee) only therein, shall not be invalidated by any act or neglect of the Mortgagor (Chargor) or the owner of the within described property or by the occupation of the premises for purposes, more hazardous than are permitted by this policy, or by the non-occupation thereof, or by any other increase of risk taking place in the property insured hereunder. Provided that in case the Mortgagor (Chargor) or owner shall neglect to pay any premium due under this policy, the Mortgagee (Chargee) shall on demand pay the same. Provided also that the Mortgagee (Chargee) shall notify the company of any non-occupancy or increase of hazard which shall come to the knowledge of the said Mortgagee (Chargee) and unless permitted by this policy it shall be noted thereon and the Mortgagee (Chargee) shall on demand pay the premium for such increased hazard for the term thereof this policy shall be null and void. And it is further agreed that whenever the Company shall pay the said Mortgagee (Chargee) any sum in respect of loss or damage under this policy and shall claim that as to the Mortgagor (Chargor) or owner no liability therefore existed, the Company shall become.

MISDESCRIPTION, NON-DISCLOSURE AND ALTERATION CLAUSE

The policy is extended to include the following paragraph  :
-    Notwithstanding the provisions of Excluded any alteration made by or known to an officer responsible for insurance of the Insured in the trade or processes of manufacture carried on at the Situation; or any alteration made by or known to an officer responsible for insurance of the Insured in the nature of the occupation or other circumstances effecting the Insured Property; whereby the risk of Damage shall have been materially increased unless a responsible officer of the Insurer shall have first been notified of any such alteration and the Insured shall have agreed to pay any additional premium required by the Insurer.

-    The Insured shall not be prejudiced by any unintended or inadvertent error, omission or misdescription of the risk, interest or Property Insured under the Policy, incorrect declaration of value, failure to advise the Insurer of any change of risk, interest of Property Insured, failure to comply with any statutory requirement or failure to advise any acquisition of interest, risk or property, provided that the Insured’s officer responsible for insurance shall, upon becoming aware of any such unintended or inadvertent act, error or omission, inform the Insurer as soon as reasonably practicable and that the Insured shall, upon request, pay any reasonable extra premium to the Insurer from the date of the increase in risk in connection with :
(a)    Any alteration made by or known to an officer responsible for insurance of the Insured in the trade or processes of manufacture carried on at the Situation ; or
(b)    Any alteration made by or known to an officer responsible for Insurance of the Insured in the nature of the occupation or other circumstances affecting the Insured Property.

OPTION 2
Clause 6.3 of the policy is extended to include the following paragraph  :

Notwithstanding the provisions of Excluded circumstances 6.3.1  and 6.3.2 the Insured shall not be prejudiced by any unintended or inadvertent error, omission or misdescription of the risk, interest or Property Insured under the Policy, incorrect declaration of value, failure to advise the Insurer of any change of risk, interest of Property Insured, failure to comply with any statutory requirement or failure to advise any acquisition of interest, risk or property, provided that the Insured’s officer responsible for insurance shall, upon becoming aware of any such unintended or inadvertent act, error or omission, inform the Insurer as soon as reasonably practicable and that the Insured shall, upon request, pay any reasonable extra premium to the Insurer from the date of the increase in risk.

ii.    Correctly recognize any date as its true calendar date;
iii.    Capture, save, or retain and/or correctly manipulate, interpret or process any date or information or command or instruction as a result of treating any date otherwise than as its true calendar date; and/or
iv.    Capture, save, retain or correctly process any data as a result of the operation of any command which has been programmed into any computer software, being a command which causes the loss of data or the inability to capture, save, retain or correctly process such data on or after any date.
v.    It is further understood that we will not pay for the repair or modification of any part of an electronic data processing system or its related equipment, to correct deficiencies or features of logic or operation.
vi.    It is further understood that we will not pay for Damage or Consequential Loss arising from the failure, inadequacy, or malfunction of any advice, consultation, design evaluation, inspection installation, maintenance, repair or supervision done by you or for you or by or for others to determine, rectify or test, any potential or actual failure, malfunction or inadequacy described in A, above.
vii.    Such damage or Consequential Loss described in A, B, or C above, is excluded regardless of any other cause that contributed concurrently or in any other sequence.
This Endorsement shall not exclude subsequent Damage or Consequential Loss, not otherwise excluded, which itself results from a Defined Peril. Defined Peril shall mean : Fire, Lighting, explosion aircraft or vehicle impact, falling objects, windstorm, hail, tornado, hurricane, cyclone, riot, strike, civil commotion, vandalism, malicious mischief, earthquake, volcano, tsunami, freeze or weight of snow.

MICROORGANISM EXCLUSION (MAP)

(Absolute)
This policy does not insure any loss, damage, claim, cost, expense or other sum directly or indirectly arising out of or relating to :

Mold, mildew, fungus, spores or other microorganisms of any type, nature, or description, including but not limited to any substance whose presence poses an actual or potential threat to human health.

This exclusion applies regardless where there is
any physical loss or damage to insured property ;
any insured peril or cause, whether or not contributing concurrently or in any sequence ;
any loss or use, occupancy or functionality or
any action required including but not limited to repair, replacement, removal, cleanup, abatement, disposal, relocation, or steps taken to address medical or legal concerns.

This exclusion replaces and supersedes any provision in the Policy that provides insurance, in whole or in part for this matters

MACHINERY BREAKDOWN (PHYSICAL DAMAGE AND EXPEDITING COSTS)

The Policy extends to indemnify the Insured for Damage to Machinery occasioned by or happening through any mechanical, electrical, electromechanical, electronic or hydraulic malfunction, failure derangement, breakdown or non-operation of any kind except as otherwise specifically excluded.
For the purpose of this extension.
  1. “Machinery” means any apparatus, including  electronic control equipment, whether functioning independently or as part of a collection of apparatus which generates, contains, controls, transmits, receives, transforms or utilizes any form of source of energy or power.
  2. The following specific exclusions shall apply to this extension and shall take precedence over the exclusions of the Policy.
Property Exclusions  :
Damage to  :
  • any sewer piping, underground gas piping, piping forming part of any sprinkler system or water piping other than boiler feed water piping, boiler condensate return piping or water piping connecting to or used with an air conditioning system;
  • any structure, foundation or setting (other than a bedplate) supporting or housing any Machinery, or the lining or fire wall of any unfired vessel;
  • any vehicle or mobile equipment whilst being driven on a public thoroughfare (but damage to such vehicle or mobile equipment whilst being used at any situation as a tool of trade is not excluded);
  • any aircraft or floating vessel;
  • any elevator, crane, hoist, power shovel, dragline or conveyor (but not any pressure vessel or electrical equipment used with such items of Machinery);
  • any computer or electronic data processing equipment;
  • any X-ray machine, spectrograph, gauges or other apparatus using radio active materials, any radio or television apparatus;
  • any penstock, draft tube or well casing;
  • any steam or gas turbine-generator with a capacity exceeding 250 horse power or equivalent;
  • electrical wiring and fittings associated with lighting and power circuits.
Excluded Circumstances :
The Insurer shall not be liable in respect of  :
(a)    (i)    wear and tear and gradual deterioration (whether by wasting, grooving, rust, corrosion, erosion or otherwise) nor for the cost of maintenance work generally;
(ii)    gradually developing flaws, deformation, distortion, cracks or  partial fractures;
Provided that Excluded Circumstances (a) (i) and (ii) shall be limited to the part(s) of the Machinery immediately so affected and  shall not apply to any other part(s) of the machinery undergoing sudden and unforeseen damage in consequence thereof.
 
(b)    repair or renewal of non-metalic parts and expendable tools, blades,  edges, moulds, dies, templates, screens, sieves, ropes, belts and like items subject to rapid wear and tear unless repair or renewal thereof is necessitated by the occurrence of Damage (as insured by this extension) to any other part(s) of the Machinery;
 
(c)    Damage :
(i)    arising from the intentional application of any tool or process to the Machinery during the course of repair, alteration, modification, maintenance or overhaul thereof.
(ii)    to the Machinery resulting from the imposition of abnormal conditions relating to testing or intentional overloading of or experiments with the Machinery, unless the Insurer shall have agreed in writing to grant indemnity under this extension whilst the Machinery is being operated under such conditions.
(iii)    to the Machinery resulting from fault(s) or defect(s) therein known to the Insured or to responsible employees of the Insured but not disclosed to the Insurer at the commencement of the Period of Insurance.
 
(d)    consequential loss of any kind (including consequential loss due to lack of   performance, loss of contract or payment in respect of any contractual fine or penalty due to late or non-performance of services by the Insured).
 
The insurance under this endorsement includes expediting expenses, which shall mean :
(a)    penalty rates for wages during overtime, shift, night, Sunday or holiday working;
(b)    payment for carriage by express passenger, fast goods or other rail or road transport;
(c)    payment for carriage by airfreight via licensed airline(S) operating a regular scheduled service but not by aircraft chartered for such carriage, unless agreed in writing with the Insurer.
The Insurer’s liability for expediting expenses shall not exceed 50 % of the normal cost of repair or replacement of the Damaged Machinery.

Notwithstanding anything stated to the contrary in Conditions 6 of the policy, the Policy shall subject to the Special Conditions hereinafter contained extend to include loss  or damage to the property insured directly cause by Landslip and subsidence whether caused by flood or otherwise.

Provided always that all the conditions of the Policy (except insofar as they may be hereby expressly varied) shall apply as if they had been incorporated herein and for the purpose hereof any loss or damage as aforesaid shall be deemed to be loss or damage by fire.

Special Conditions :
1.    The liability of the company in no case under this endorsement and the policy exceed the sum insured by each item of the policy.
2.    The property shall be maintained in good and substantial state of repair.
3.    The insurance under this endorsement does not cover :
a.    The cost of repairing, cleaning or making good drains of water courses.
b.    Consequential loss of any description.
c.    Loss caused by earthquake.

LANDSLIDE AND SUBSIDENCE CLAUSE (BROAD)

Insurance under this Policy is extended to cover physical loss to insured property caused directly by sudden violent earth movement within the site on which insured property is situated, but excluding:
(i)    loss in any manner connected with earthquake, coastal erosion, overloading of the insured building, or any constriction work.
(ii)    loss to outdoor property.
(iii)    loss attributable to faulty design, inferior workmanship or use of defective materials.
(iv)    settlement of or cracks in any insured building unless part of the building has physically collapsed.
(v)    cost and expense to make good or remove debris of land, except as necessary to repair damaged insured property.
(vi)    a Deductible of the first S$ XX,XXX/- of each loss payable under this extension.

Provided always that the Company's liability in respect of this extension shall not in any way exceed the Limit of Indemnity specified in this Policy.

JETTY CLAUSE

LOSS OF DAMAGE GOODS CLAUSE

In case of damage to property bearing brands labels and trademarks the sale of which carries in any way a guarantee of the Insured, the salvage value of such damaged property shall be determined after the removal in the customary manner of all brands labels and trademarks which might be taken to indicate that the guarantee of the notwithstanding anything to the contrary elsewhere herein, it is understood and agreed that in case of damaged to goods insured under this policy due to a peril insured against, the Insured or their representatives are to retain control of all damaged goods. The Insured, however agrees wherever practicable to use recondition or sell such goods, the sale being made after removal of all brands labels  or trademarks, with the Insurer being entitled to the proceeds of the sale. Where the use or disposal or sale of damage goods would be in the opinion of the Insured or they representatives detrimental to their interest such damage shall be treated as constructive total loss and the insured shall destroy the damaged goods in the presence of a representative of the Insurer and the Insured.

This policy is held to include :

1.    wages of the Insured’s employees other than full time members of a Works Fire Brigade
2.    the cost of replenishment or resetting of fire fighting appliances or apparatus and loss destruction or damage to materials (including employees effects)
3.    other costs (including loss, destruction or damage to property to gain access).

Necessarily and reasonably incurred in extinguishing fires or in saving or recovering property or saving life resulting from the operation of any peril insured against at or in the vicinity of the situation of the property or threatening to involve such property.

It is hereby noted and agreed that MARUBENI CORPORATION and SUMITOMO CORPORATION (hereunder know as the Loss Payee) has a financial interest in the insured property to the extend of the sum insured.

In consequence thereof payment of any loss arising under this Policy shall only be made with the written permission and consent of the Loss Payee.

It is further declared and agreed that payments of any loss shall be made , at their option to the Loss payee provided always that such payment shall not exceed the financial interest of the Loss Payee in the insured property.

Nothing in this clause shall in any way extend the liability of the Company beyond such liability as would have been in the absence of this clause.

Subject otherwise to the terms exceptions and conditions of the Policy.

LOSS PAYABLE CLAUSE

In accordance to the Banker’s Clause attached in policy, any claim less than or equal to USD. XXX,XXX shall payable to PT XXX account unless the Bank shall give it’s written consent that any such claim shall be released to the Insured.

In the event of non – payment of premiums when due, the Insurers undertake not to exercise any right of cancellation which they may have without giving 4 (four) weeks prior written notice of such cancellation to the Bank. The Security Agent may, but shall not be obliged to, pay any balance of such premiums which may be in default and it is expressly understood that the Bank shall not be liable for any non-payment of premiums.

The Bank shall be advised by the Insurers:
(i)    Immediately of any material changes which are proposed to be made to any of the terms of the insurances or if the underwriters or reinsurers thereof cease to be underwriters or reinsurers thereof and;
(ii)    Not later than 14 (fourteen) days prior to the expiry of any of the insurances if  instructions have not been received for the renewal or further renewal thereof and in the event of instructions being received to renew or further renew, the details thereof.

The Insurers shall also promptly advise the Bank in writing of any act or omission of which the Insurers are aware that might render this policy void or make the same invalid or unenforceable in whole or in part.

Selamat pagi Akademia. Pagi ini saya hendak berbagi mengenai devinisi underground activities dalam asuransi HE / CPM. Beberapa asuransi kadang melekatkan perkecualian underground activities karena dalam bayangkan kita, underground activities adalah pekerjaan di bawah tanah yang cenderung sangat berrisiko terkena longsoran tanah dan sebagainya.

Seorang broker pernah bertanya: Mohon dapat dijelaskan “excluding underground activities”. Apa yang dimaksud dengan underground, mengingat pekerjaan construction dengan alat bored kemungkinan untuk mengerjakan proyek pemb uatan diafragma wall (dinding penahan underpass), atau pembuatan basement parker, di mana ada galian tanah, kemudian alat itu bekerja di bawah tetapi bukan seperti pekerjaan dalam pertambangan. Kiranya anda dapat menjelaskan kepada kami supaya tidak terjadi “grey area” bilamana sampai terjadi klaim.

Penjelasan:
Sebetulnya underground work sangat jelas, yaitu semua pekerjaan di bawah permukaan tanah. Sehingga tidak perlu ada “grey area”
Definisinya:
Underground structures: structures built beneath the earth’s surface. Such components of underground construction as architectural planning, construction methods, structural elements and their shoring, and waterproofing and air conditioning are determined by the structure’s purpose and the properties of the surrounding rock or earth.
Underground structures fall into several groups:
  • Transportation and hydraulic-engineering tunnels;
  • Subway facilities;
  • Power plants, chiefly hydroelectric;
  • Warehouse and cold storage;
  • Such municipal installations as pedestrian underpasses, garages, and municipal conduits;
  • Reservoirs for drinking water; facilities for oil and gas storage;
  • Containers for burying harmful industrial wastes;
  • Industrial enterprises;
  • Medical institutions;
  • And military installation.
  • A special group consists of the underground structures of mines located at the shaft bottom: underground power plants; car parks; and pumping and medical stations. This group also includes facilities connecting the surface structures with the working faces: mine shafts, main drifts, and galleries.

Risk in underground works can be include:
1.    Potential damage to the properties of third parties
2.    Risk to the contractor’s work force and equipment
3.    Risk to partially complete works of the employer

Cause of loss can be:
1.    Natural hazard
2.    Lack of construction skill/bad workmanship
3.    Poor construction material
4.    Etc.
